The “business” that has been lodging all the documents concerning 25 Marine Parade and many other DA submissions, claims at various times, and on various documents to be one of:-

  • I.B Town Planning
  • I B Town Planning
  • IB Town Planning
  • I.B. Town Planning

We have discovered that none of the above used business trading names has ever been registered with ASIC (Australian Securities & Investments Commission).

It is a Legal Requirement that any such business names must be registered with ASIC.

ASIC has been alerted to the non-compliance.

The City of Moreton Bay has been inappropriately dealing with an illegally operating “business” by accepting planning development lodgements and information responses made by the offending planning agency. All lodgements presented by the illegally operating business must be seen as tainted and “not properly made”.

The question now arises, does that make forms lodged by an illegally operating business null and void?
The lodgements are certainly not being properly made. They are lodged under the false pretences that they are coming from a legitimate business.

The City of Moreton Bay has been alerted to the issue and has responded very quickly with:-

Council should now reject all applications/decisions in relation to IB Town Planning where:

  • Applications are pending
  • Applications approved and no construction commenced
  • Discard all newly submitted applications
  • Discard all submitted Information Responses
  • Cease accepting lodgements from the business

Financial Implications

A Registered Business is required to lodge BAS (Business Activity Statements) regularly to show and account for G.S.T. collection and claims. Perhaps all payments for the services rendered were made in cash? If BAS statements were being lodged in some other name, then what name was that?


We now wait and will monitor what action Council’s Legal Services team proposes. If Council’s Legal Services team condone the dealings Council has had with “IB Town Planning”, then we might be warranted in seeking further legal advice.
